LOSS OF THE "KILDARE”
A telegram was received in town this morning from Singapore briefly stating that the fine new steamer Kildare, Capt. Johnson, had been abandoned on the 29th September somewhere in the vicinity of the Paracels, with a loss of four lives. The Kildare left Java for this port on the 17th September with a cargo of sugar for Messrs. Butterfield and, Swire, and there can be very little doubt that she encountered the typhoon which swept down the China Sea with such disastrous effect about the 28th and 29th ulto. It seems probable that the crew, with the exception of those lost, were picked up by passing steamer and taken on to Singapore.
The unfortunata vessel was owned by Messrs. R.. M. Hudson & Co. of Sunderland, and had only been engaged for a few months in the China trade. She was 2,277 tons burthen and classed 100 At at Lloyds.
We understand that the Kildare's cargo of some fifty thousand piculs of sugar was insured with two local offices for something over $200,000,

1-NEWCHWANG DISTRICT. Lights required:-Light-ship off the Bittern Shallows, Light on North Point, Iron Island, and Liau-ti-shan Promontory. At the present time the whole Newchwang District has only one light, namely, the Light-ship off Liau River so that from Chefoo to the Light-ship, a distance of 198 miles, there are no lights. The Light- ship ought to hoist the water on the bar by flags from her mast-head, as it would be a great assistance to captains and piles. It is done by the Customs at Taku, and why not at New- chwang? A good tide pole ought also to be placed in the deep hole on the right hand side going in, which would be of great use to all vessels going out.

Indeed, the prosecution admitted hat passengers' luggage, which in these vessels is often more in quantity than the cargo carried, is not required to be entered in. the manifest and. there are many exceptions by general manner of understanding, such &c. But it is clear that the manifest must as bags, parcels, at least contain a just and, to the best all packages of dutiable articles carried on board with the master's, knowledge, and if knew that the 36 tins of opium were being carried on board, or even that while as it appeared he did not, as a matter of fact, kaow of their presence, that he ought to have known, alleged that he knew the opium was there and 'should have convicted him. But it is not even.
it is shown that it was so artfully concealed that a trained search party could only discover is when the precise locality was pointed out to them. It can be inferred, therefore, that no ordinary search on the part of the master after it had come on board would have led to his detecting it, and it is shewn, hioreover, that he took proper precautions to prevent it being smuggled on board by engaging four watchmen specially for to have had knowledge of it is due not to default on his part, but to the corruption of those on whom he had to rely. It paid those whose duty it was to have known of the opium being there, and who actually did know it was there, better to act as informers for the Customs than to inform the master, and so long as the ship's employes are paid by the Customs to act as informers for them it is evident that the master of the vessel is unable to prevent a recurrence of these cases. As regards the cases referred to by the prosecution; I do not find that they support the contention. In the case of the Takeon, which is the only case in which the Consul's decision is before me in which the chcumstances were very similar to those in the present case, bave that the quantity of opium was about three times as much, the Consul acquitted the captain and his decision was upheld. In the other two cases to which he especially refers me, no prosecution appears to have been entered, and as decisions therefore they cannot be quoted, but if they bad been cases decided in Cout they do not seem to me at all similar to the present. In the case of the Douglas the captain paid a packages of merchandise on board not catered in fine to the Customs of Ts. 50-having 66 his manifest, and in the case of the Haiphong, the captain paid a similar fine to the Customs, baving 127 packages in excess. Indeed, neither they or the numerous other cases to which he refers me even sustain the contention that they shew conclusively that in the general under- standing of the mercantile world in China the captain is liable to a fine for false ntanifest if smuggled goods like this offium are found on board his vessel. I have gone through some thirty of those he has specially marked, but they only show that in many cases in which there were mistakes in the manifest, or smuggled goods found on board, the merchants have pre- ferred paying small sums of taels 3, tacis 5, or facts 10 to the Customs rather than delay their ships and put themselves to the trouble and expense of a case in Court.
