applicant and have been used in Hong Kong for not less than two years. Registration in Part A gives full rights of protection, in Part B modified rights. Registrations are valid for seven years, but may be renewed indefinitely for further periods of fourteen years. Defensive and certification trade marks may be registered, and a person other than the proprietor of a mark may be registered as a registered user. The procedure and forms to be used are set forth in the Trade Marks Rules, 1954.

Applications and Registrations

78. The active trading conditions prevailing throughout the year were reflected in the record number of 1,994 applications received this being 152 more than the number received in 1961-62. Of these applications 1,986 were for registration in Part A of the Register, and 8 for registra- tion in Part B. While the number of applications accepted remained almost stationary at 1,361, there was a large increase of 468 in the number of marks registered, the year's total being 1,563, comprising 1,519 registrations in Part A and 44 in Part B.

79. Table XIV gives the numbers of marks registered in each of the thirty-four scheduled classes, and Table XV shows the countries of origin of the applications for the 1,563 marks registered. In each case the previous year's figures are included for comparison. As compared with 1961-62 the numbers of marks registered increased in all but five (7, 10, 12, 13 and 24) of the scheduled classes. The most notable in- creases took place in classes 1 (Chemical products) up 32 to 73, 3 (Soaps, perfumery, cosmetics, etc.) up 41 to 123, 5 (Pharmaceuticals, etc.) up 54 to 328, 14 (Horological instruments, etc.) up 53 to 76, 25 (Clothing) up 103 to 229, and 34 (Tobacco, etc,) up 32 to 86. The top six countries for registration remain the same as for 1961-62, namely, Hong Kong with 496 (up 99), the United States of America with 349 (up no less than 152), the United Kingdom with 247 (up 77), Japan with 95 (up 18), West Germany with 93 (up 16), and Switzerland with 49 (up 10). The Netherlands, however, seventh highest in 1961-62 drops to eleventh place behind Italy 37 (up 31 from only 6), France 27, Singapore 23 and Australia 21. The sharp increase in Italian registra- tions may to some extent have been connected with the exhibition of Italian products held between the 1st and 15th March 1963.

80. 879 marks having been removed from the Register for non-pay- ment of the registration renewal fee, and 41 cancelled at the request of the registered proprietors, the total number of marks on the Register
