5. Every person who commits an offence against this Ordinance, and every person who attempts to do any act which would be an offence against this Ordinance, shall upon summary conviction be liable to a fine not exceeding five hundred dollars and to imprisonment for any term not exceeding six months, and shall upon conviction on indictment be liable to imprisonment for any term not exceeding five years.
