An Ordinance to amend the law relating to

intoxicating liquors.

Be it enacted by the Governor of Hong Kong, with the advice and consent of the Legislative Council thereof, as follows:-

1. This Ordinance may be cited as the Liquors Amendment Ordinance, 1928.

2. Section 2 of the Liquors Consolidation Ordinance, 1911, hereinafter called the principal Ordinance, is amended as follows :-

(a) By the repeal of sub-section (11) thereof. (b) By the repeal in sub-section (13) thereof of the words "in the case of Chinese Wines and Spirits, seven and a half catties shall be deemed to be the equivalent of the imperial gallon ". (c) By the insertion after sub-section (20) thereof of

the following sub-section :-

20A. "Person", except so far as relates to the imposition of the penalty of imprisonment, includes a body corporate and a firm.

(d) By the insertion in sub-section (29) thereof after the word "6 Exports", of the words "and any Assistant Superintendent of Imports and Ex- ports".

3. Section 3 of the principal Ordinance is amended as follows:-

(i) By the repeal of sub-section (1) thereof and the substitution of the following sub-section there- for :-

(1) No person who has not got a licence under this Ordinance shall

(a) make, distil, or rectify any spirits, or (6) knowingly keep or have in his posses- sion any still or other utensil or apparatus suitable for making distil- ling or rectifying spirits, or

(c) without lawful authority or excuse have in his possession, tustody, or control any fermenting or fermented material.

(i) By the substitution of the words "Superinten- deut of Imports and Exports" for the words

4. Section 4 (1) of the principal Ordinance is amended Superintendent of

5. Section 6 (4) of the principal Ordinance is repealed of Ordinance and the following sub-section is substituted therefor No. 9 of

1911, s. 6 (4).

(4) Nothing in this section shall be deemed to affect owners, charterers, or agents of ships who import any intoxicating liquor solely for the purpose of export under through bills of lading.
