were free from any mortgage, pledge, lien or other similar obligation, and in a case where the property requisitioned is a vessel, aircraft or vehicle may acquire it by serving on the owner of the vessel, aircraft or vehicle a notice stating that he has acquired it in pursuance of this order. Where a notice of acquisition is served under this paragraph on the owner of any vessel, aircraft or vehicle, then at the beginning of the day on which the notice is served—
(a) the vessel, aircraft or vehicle shall vest in the Governor free from any mortgage, pledge, lien or other similar obligation, and
(b) the period of the requisition thereof shall end.
3. The owner or occupier of any premises in this Colony shall, if required by the competent authority authorized by this order to requisition any property, furnish to the com- petent authority a written declaration stating or estimating whether or not on such date as may be specified in the requirement any such property is or will be on the premises and, if so, the number or quantity of articles or substances comprising it which was or will be on the premises on that date.
4. The competent authority authorized by this order to requisition any property may, by inserting in the requisition such time and place for delivery of any property to which the requisition relates as he may think fit, require the property to be delivered at that time and place, and it shall be the duty of the owner of the property to deliver the property at the place and time specified in the requisition, notwithstanding that a receipt for the property may have been given by the officer mentioned in the requisition. The property mentioned in the requisition shall not be deemed to have been furnished until proper delivery has been made at the place and time stated in the requisition.
5. The sum to be paid for any property or the use of any property shall be deemed to have been tendered when a formal receipt for the property. setting forth the amount, is handed to the owner or his representative.
6. A requisition purporting to be issued in pursuance of this order and to be signed by a competent authority specified in the schedule shall be evidence until the contrary is proved of its being duly issued and signed in pursuance of this order.
7. Where a competent authority has issued his requisition for the provision of any property and any person ordered in pursuance of the requisition to furnish the same refuses or neglects to furnish it according to the requisition, then the competent authority may seize (and if need be by force) the property requisitioned and may use the same in like manner as if it had been furnished in pursuance of the requisition. But the said person shall be entitled to payment for the same in like manner as if he had duly furnished the same according to the requisition.
8. Every requisition under this order shall be deemed to be by or on behalf of the Governor.
