Addition of

new subsec- tion (4) to section 22 of Ordinance No. 24 of 1927.

8. Section 22 of the Hong Kong Police Reserve Ordin- ance, 1927, is amended by the addition at the end thereof of the following sub-section--

(4) determination of services in accordance with the regulations.

Objects and Reasons.

The amendments in clauses 2, 3 and 4 of the bill bring the titles in the Police Reserve into line with the titles of those now in use in the Police Force.

Clause 5 of the bill sets out with greater clarity than did section 17 of the Ordinance which it replaces the grounds on which a member of the Reserve may be dismissed.

The subject matter dealt with under sub-section (2) and (3) of section 18 of the Ordinance is largely covered by regulations 4 and 5 made under the Ordinance [pages 999 and 1000 of Vol. III of the Regulations of Hong Kong (1937 edition)]. It is considered more convenient to deal with the subject by regulation, consequently clause 6 of the bill repeals these sub-sections.

The wording of section 19 implies that a member of the reserve must in all cases pay the cost of his uniform if he resigns or is dismissed within 12 months of joining. This may be inequitable in certain cases, e.g., if the member is transferred outside the Colony. The amendment in clause 7 makes the requirement to pay for uniform optional at the discretion of the Commissioner of Police.

Clause 8 of the bill adds a fourth ground on which a person may cease to be a member of the Reserve, viz., determination of his services. There may be cases where a person becomes unsuitable by temperament or otherwise to continue in the Reserve and where dismissal is not called for. By this amendment his services in the Reserve may be determined.
