5. Nothing in this order shall authorize any person to make any photograph, sketch, plan or other representation-

(a) while on board any vessel; or

(b) which is forbidden by the Defences (Sketching Pre- vention) Ordinance, 1895; or

() in contravention of the Official Secrets Acts, 1911 to 1939; or

(d) of any place or area declared to be a protected place 2 & 3 Geo. 6, or a protected area under regulation 32 or 33 of the Defence

Regulations, 1940.

Notes.

(1) The effect of this order is to make it an offence, without the written permission of the Chief Security Officer, to carry a camera or take a photograph elsewhere than in the urban area in Hong Kong below Bowen Road from Causeway Bay to West Point and the urban area in Kowloon including Shamshuipo, Kowloon Tong and Kowloon City south of the aerodrome of Kai Tak which is outside the area where photography is permitted. Cameras may be taken across the harbour by the Star and Hong Kong and Yaumati Ferries only but photographs may not be taken from a ferry.

(2) Section 2 (1) of Ordinance No. 1 of 1895 is as follows--- "It shall not be lawful for any person, whether a British subject or an alien, to make or attempt to make or have in his possession, custody, or control, any sketch of any battery or of the field of fire of any weapon therein, or of any naval or military or air force premises or anchorages or landing, firing, bombing or roinefield areas, or of any of His Majesty's ships or aircraft without the permission in writing of the Governor.

(3) By section 1 of the Official Secrets Act, 1911, any person who-

makes any sketch, plan, model, or note which is calculated to be or might be or is intended to be directly or indirectly useful to an enemy

is guilty of felony, and by section 2 of the same Act it is a mis- demeanor to have possession of any sketch or information which relates to or is used in a prohibited place or anything in such a place. Prohibited place includes works of defence, naval, military or air force establishments, ships or aircraft, and extends to premises used solely in connexion with munitions of war and to minefields.
