BE it enacted by the Governor of Hongkong, with the advice and consent of the Legislative Council thereof, us follows

1. This Ordinance may be cited as "The Wireless Telegraphy Amendment Ordinance, 1909" and shall be read and construed as one with the Wireless Telegraphy Ordinance, 1993, and the Wireless Telegraphy Ordinance, 1909, and this Ordinance and the said Ordinances may be cited together as "The Wireless Telegraphy Ordinances, 1903-1909 ".

2. The following shall be inserted and read as section 5 of the Wireless Telegraphy Ordinance, 1903 :----

5. If any person establishes or uses within the Colony any installation for the purpose of wireless telegraphy without a licence under this Ordinance he shall be guilty of a mis- demeanour and shall be liable to imprisonment with or without hard labour for any term not exceeding one year or to a fine not exceeding one thousand dollars or both and in either case be liable to forfeit any apparatus for wireless telegraphy installed or worked without *! licence, but no proceedings shall be taken against any person under this section except by order of the Governor.”

3. Section 2 of the Wireless Telegraphy Ordinance, 1909, is hereby amended by the addition at the end thereof of the following words :--

not exceeding one hundred dollars for each offence and may provide for the forfeiture on any such breach of any apparatus for wireless telegraphy installed or worked on such ships". Passed the Legislative Council of Hongkong, this 9th day of December, 1909.
