HONG KONG: AGREEMENT BETWEEN THE HONG KONG GOVERNMENT AND THE

EUROPEAN COMMISSION TO ESTABLISH AN EC COMMISSION OFFICE IN

HONG KONG

Problem

1.

An entrustment is required to authorise the Governor to

conclude an international agreement between the Hong Kong

Government and the Commission establishing the planned

Commission office in Hong Kong and conferring relevant privileges and immunities.

Recommendation

2.

I submit an entrustment in the form of a letter from the

Secretary of State to the Governor (to be conveyed to Hong

Kong by Mr Morris from HKD). I also submit 2 telegrams, one

informing Hong Kong of the dispatch of the entrustment and

another with the text. Our Departmental Legal Adviser agrees.

Ministers agreed last month that Hong Kong be authorised to enter into an agreement with the Commission Miss Conroy's submission of 22 September. Further background to the
