FUTURE CONSULATE-GENERAL IN HONG KONG: PRIVATE TREATY GRANT

(PTG)

Problem

1.

How to resolve remaining differences between ourselves and

the Hong Kong Government over the terms of the Private Treaty

Grant (PTG) under which we will be granted the Colvin House

site.

Recommendation

2.

I recommend that we enlist the aid of the Constitutional

Affairs Bureau (CAB) and if necessary take the matter to the

Governor

to secure better wording on compensation in the event of expropriation than HKG have so far offered.

Background

3. The leasing of land in Hong Kong is at the discretion of the

Sino-British Land Commission (LC). Under the terms of the LC

the future SAR will receive 50% of the premium generated by
