OUTLINE OF PROPOSALS FOR A PATENTS BILL

INTRODUCTORY

Short title and commencement
This clause will provide that the provisions of the proposed Patents Bill will come into operation on a date or dates to be appointed by the Governor.

Who may apply

The persons who may apply for the issue of a patent are:

the applicant for the European Patent Application
Note
(For example: the persons whose names appear in the published European Patent Application (EPA) issued by the European Patent Office (EPO)),
the successor in title to the EPA
Note
(For example: where A the EPA applicant on publication assigns to B and B, before the recordal in the EPO, applies in Hong Kong then B will be the successor in title and will need to produce an assignment document or consent), or
any other person entitled to apply in HK who derives title through, from or under the EPA applicant
