sufficient publicity is given to the new system, persons requiring protection for their patents in Hong Kong should not be prevented from obtaining such protection by the cutting down of this time period.

UK application or EPA (UK) either published but not granted or made but not published at the date of introduction of the new system

10.57.

We propose that applications which have been made to the UKPO or to the EPO designating the UK and which have been published but not granted or, in the case of the UK application, made but not published at the date of introduction of the system will still be able to be registered as HK patents under the new system provided that the relevant application is made within the specified period of time.
