The provisions of the 1965 Act which relate to liability for the carriage of nuclear material therefore at present constitute part of the law of Hong Kong. These provisions will however lapse on 30 June 1997 unless localised.
Although it is not expected that consignments
of
nuclear material to and from nuclear installations will pass through Hong Kong frequently, or indeed at all, it would nonetheless be prudent to allow for the possibility of such a consignment giving rise to claims for injury or damage in Hong Kong. It is therefore appropriate that this topic should be enacted in Hong
local legislation on
Kong which can continue in force after 30 June 1997.

..The People's Republic of China is not a party to the Paris Convention or its Protocol. However, on 3 June 1993, the Chinese side informed the British side that the Chinese side agreed in principle to the continued application of the Paris Convention and its Protocol to the Special Administrative Region after 1997. Discussion will in due course take place in the International Rights and Obligations Sub-group of the Joint Liaison Group on the action to be taken by the two sides to ensure the continued application to the Hong Kong Special Administrative Region after 30
1997 of the international rights and obligations affecting Hong Kong which arise out of the Convention and Protocol. Meanwhile, for the reasons mentioned in para. 6, it is appropriate the international agreements in question should continue to be implemented in Hong Kong's domestic law by legislation which can continue in force after 30 June 1997.
