I confirm that it is our intention to base the localisation Bill on the Food and Environment Protection 1985, which updates the present legislaton applying to Hong Kong and also implements the 1978 amendments to the 1972 Convention relating to incineration at sea.

We

agree that it is appropriate to mention the new substantive provisions in the paper and for that purpose, propose to replace the third sentence of paragraph 6 of the consultation paper with the following:

"The bill will incorporate certain provisions of the 1985 Act which relate to incineration at sea and implement the 1978 amendments to the Convention. In other respects, the overall effect of the legislation will be essentially the same as that now achieved by the 1974 Act as applied to Hong Kong.
