TRANSFER OF SENTENCED PRISONERS: HONG KONG
We spoke briefly about the possibility of a UK/Hong Kong Agreement on the Transfer of Sentenced Prisoners, to have effect post-1997.

A Hong Kong team is in London until 21 December to discuss a range of co- operation agreements, including extradition. At the end of those talks, yesterday, I was asked to raise with the relevant people in the Home Office whether you would be interested in continuing repatriation arrangements after 1997. I understand that the UK has extended to Hong Kong both the Council of Europe Convention and the bilateral agreement with Thailand; and that Hong Kong makes considerable use of both. The Hong Kong Government is in the process of "localising" this and other legislation, and of drawing up a list of countries with which they wish to continue doing business, and a model agreement, for approval by the Chinese. The UK is not yet being mentioned, in any context, to the Chinese, but the Hong Kong authorities wish to have ready a collection of negotiated texts for presentation at a later date.
