Nature of Problem
Wide discretion on the part of the Broadcasting Authority in relation to prohibiting broadcasting on grounds of content and broadcasting of material rendered by certain individuals.
Relevant Action
The Television (Amendment) Bill 1993 was introduced into the Legislative Council on 13 January 1993. In order to make the Television Ordinance more compatible with the Bill of Rights Ordinance, the Bill proposes to remove or modify provisions which are unnecessary or which give the Government or the Broadcasting Authority wide discretionary powers, now regarded as perhaps boo wide.

Discretionary powers of the Covermoor in respect of transmission and interception of telcœmunication messages.
The Law Reform Commission is presently examining Hong Kong laws affecting privacy, including interception of communications. The Administration would wish to take the Law Reform Commission's views into account when deciding whether the existing legislation needs to be amended in the light of the DOR.

New Territories Ordinance
The Ordinance may be used to recognise and enforce Chinese custom affecting NT land which lay down rules for the inheritance of ancestral land along the male line.

The Amministration ches not agree that the legislation is discriminatory in nature. people are a distinct minority and their culture/customs may justify laws and practices which might otherwise be regarded as discriminatory. See relevant part of CS' speech in moving the Second Reading of the BOR Bill on 25 July 1990.
