UK draft of a UK/US Exchange of Notes
I have the
honour to refer to the Agreement between

the
Government of the United Kingdom of Great Britain and Northern
Ireland and the Government of the United States of America
concerning Air Services, done at Bermuda on 23 July: 1977; and to

Hong Kong shall cease to be regarded as territory of
the "United Kingdom for the purposes of the said
Agreement, except, until 30 June 1997, for the
purposes of Article 2(4) thereof;
(ii) in Annex 1 to the said Agreement, UK Route 6, UK Route
13, US Route 3 and US Route 8, as well as paragraph 8
.
of Section 5, shall be deleted, and Hong Kong shall be
deleted from column (c) in US-Route 2
If the foregoing proposal is acceptable to the Government of the
United States of America, I have the honour to suggest that the
present Note and Your Excellency's reply to that effect shall
constitute an agreement between the two Governments which shall
enter into force on the date on which an Air Services Agreement
between the Government of the United States of America and the
Government of Hong Kong enters into force.

REPLY
I have the honour to acknowledge your Note of today's date which
reads as: follows:

In reply, I have the honour to inform you that the foregoing
proposal is acceptable to the Government of the United States of
America who therefore agree that your Note together with this
reply shall constitute an agreement between the two Governments
which shall enter into force on the date on which an Air Services
Agreement between the Government of the United States of America
and the Government of Hong Kong enters into force.

1. One point which occurred to me, when I read your letter of 3 September to Mr Wilson Fung, concerned the treatment under our existing arrangements with the Americans of any capacity operated by a US designated carrier on the RTW route. Since Annex 2 to Bermuda 2 applies to US Route 2, ie the RTW route, and since the capacity arrangements in Annex 2 are defined in terms of frequencies on a gateway route segment, the result is that I imagine in practice we do not mind very much if capacity is mounted on the RTW route; indeed, on the contrary, since any such capacity would reduce the amount of capacity which could be operated end to end between gateway route segments, our airlines might even prefer that the capacity were operated in that way.
