UK/SOUTH AFRICA AIR SERVICES AGREEMENT:

The South African Department of Transport has finally given a substantive reply to the draft exchange of notes. A copy is attached to this fax: the hard copy will follow by bag. They have two suggestions:

the changed placing of the restriction-on-stopover clause in Note 3 to Route II. This seems sensible, and merely rectifies a drafting error in the original draft, as I mentioned in my letter to you of 14 April.

an amendment to Article 18 of the Agreement (signed at London on 11 August 1992), removing the phrase "except with respect to air services between Hong Kong and the Republic of South Africa to which the 1945 Agreement shall continue to apply until such

such time as it is replaced by Agreement between the Contracting Parties". I would have thought that this point was adequately covered in the text of our proposed exchange of Notes and their amendment may in any case raise difficulties about what is the "date of signature" in question.

I await instructions.'
