Control of foodstuffs (including dairy products) imported to Hong Kong that have exceeded the mutually agreed radiological control standards and the acceptance of

acceptance of up-to-standard foodstuffs (including dairy products) by the Hong Kong side and guarantee

measures.

The Guangdong side guarantees that when the Guangdong Nuclear Power Station is in an off-site emergency situation, foodstuffs (including dairy products) that have been proved by monitoring to have exceeded the mutually agreed control standards will not be exported to Hong Kong.

When the Guangdong Nuclear Power Station is in the intermediate or late phase of an off-site emergency, the Guangdong side will not export to Hong Kong foodstuffs (including dairy products) that are produced within the ingestion EPZ and which do not meet the mutually agreed control standards by both sides.

(b) In the food export ports within the ingestion EPZ in Shenzhen and Huizhou (Man Kam To, Aotou, Gangkou), foodstuffs (including dairy products) from these areas will be monitored by the Guangdong Commodities Inspection Bureau in the intermediate and late phases of an off-site emergency at the Guangdong Nuclear Power Station. Foodstuffs (including dairy products) that are not up to standard will be sealed up for safekeeping or destroyed on the spot.

Both sides agreed to continue to discuss the certification and monitoring of foodstuffs originating from outside the 50 km EPZ in accordance with the agreed control standards

Acceptance of up to standard foodstuffs (including dairy products) by the Hong Kong side and Guarantee Measures

After the notification of an off-site emergency at the nuclear power station, the Hong Kong side will monitor foodstuffs (including dairy products) from the ingestion EPZ by checking the certification, by screening and by sampling and will monitor foodstuffs (including dairy products) from outside the EPZ by screening and sampling. The Hong Kong side will immediately notify the Guangdong side, and take countermeasures when the contamination level is close to or above the control standards. The Hong Kong side guarantees that all foodstuffs (including dairy products) up to the radiological control standards agreed by both sides after monitoring will not be refused on radiological contamination grounds.

2.4

Co-ordination and Arbitration in the event of the Hong Kong side discovering any food that has exceeded the mutually agreed control standards

In the event of an off-site emergency at the Guangdong Nuclear Power Station, if foodstuffs (including dairy products) are found by the Hong Kong side not to be up to mutually agreed control standard, there should first be co-ordination between organisations of both sides for emergency work as soon as possible. If no consensus can be reached through co-ordination, these foodstuffs will be returned to their original ports of export. Both sides may call upon a mutually agreed arbitration organisation to examine and arbitrate on the
