Extension of Copyright Act 1956 to Hong Kong

Your fax of 13 August 1993 to Mr Peter

Harrison of the Recreation and Culture Branch raised the

question of the legal effect of the Copyright (Hong Kong) (Amendment) Order 1990. We cannot agree with your latest legal advice that despite the intention to

preserve the copyright regime for Hong Kong, all that

paragraph 36 (2) of Schedule 1 to the 1988 Copyright, Designs and Patents Act ("the 1988 Act") had succeeded doing was to "freeze" Hong Kong's copyright regime as the time of the enactment of the 1988 Act, and that

any action taken by HKG under powers conferred by the

1990 Order is null and void.
