HONG KONG: SUBSCRIPTION TELEVISION COPYRIGHT PROTECTION

Thank you for your minute of 30 July which I have used to prepare the enclosed draft reply to Hong Kong.

I copied the draft reply to Judith Sullivan in the DTI to let her have sight of our thinking so that she could reply to the letter from the IFPI. She has discussed the matter with her legal adviser and their views are set out in the attached letter, which I have not attempted to summarise, but as you will see it raises a number of problems, as well as suggesting other possible solutions.

As this seems to be a fairly complex legal matter involving a number of Acts and Orders, I feel that it would be best if you could discuss it with the DTI legal adviser and then advise me how best to proceed. If necessary I think we should consult Hong Kong for their views.

I should like to get something to Hong Kong next week, even if it is only another interim reply.
