In section 16 (6) after the word "broadcast" there shall be

inserted the words ", cable programme".

In section 13 (3) (right of owner of copyright in respect

of infringing copies etc.) for the words "a sound broadcast"

there shall be substituted the words "a sound broadcast or a

cable programme" and for the words "er broadcast" there shall

be substituted the words "broadcast or programme".

17.

In section 24 (2) (general provisions as to jurisdiction of

tribunal) for the words "cause the work or an adaptation

thereof to be transmitted to subscribers to a diffusion

service" there shall be substituted the words "include the work

or an adaptation thereof in a cable programme" and for the

words "or to broadcast it" there shall be substituted the words

"to broadcast it or to include it in a cable programme".

Section 40 (broadcast of sound recordings and

cinematograph films and diffusion of broadcast programmes) is

amended by adding

Where a television broadcast or sound broadcast

is made by any organisation specified in Schedule 1 to the

Copyright Ordinance (Cap. 39) from a place in Hong Kong,

and the broadcast is an authorised broadcast, then,

subject to subsection (3A) below, any person who, by the

reception and immediate re-transmission of the broadcast,

includes a programme in a cable programme service, being a
