"In the proposal, if any employee is dismissed on

grounds of union membership or activities, he may make a

claim for compensation to the Labour Tribunal, and the

burden of proving that the dismissal is not

discriminatory should rest with the employer.

"Employers failing to discharge the burden of proof

will be liable to pay a compensation to the employees,"

Mrs Fok said.

On the question of collective bargaining, Mrs Fok

said that after reviewing the state of development of trade unions and the overall labour relations situation

in the territory, the Government considered it more

advisable to continue the current policy of encouraging

voluntary collective bargaining.

"In fact, this policy has been working well so far

as can be seen from our record of harmonious labour

relations."

Mrs Fok said that LAB members were also briefed

that the LAB's Committee on Labour Relations, which

comprised of very experienced representatives from

employees and employers, would be consulted on

on all

proposals.
