"The provision of long service payments under the
Employment Ordinance is a practical alternative to
unfair dismissal legislation as it provides monetary
compensation to a dismissed employee upon termination of
his employment."
In order to enhance the protection of employees on
strike, the Commissioner for Labour said the Government
proposed that an employee's eligibility to severance
payment and long service payment should be retained if
he is summarily dismissed for refusal to work during a
strike period.

"Such protection will be provided only when
striking employees have given not less than seven days'
written notice to their employers indicating their
intention to strike.
"The seven-day period will enable both parties to
calm down and to hasten direct negotiation and will also
give the Labour Department time to conciliate in the
dispute," Mrs Fok added.

Turning to the protection against
discrimination, she said that a proposal has been made
to enhance the protection and to overcome the technical
difficulty of establishing in court the employer's
intention to discriminate.
