3. Reporting of data
In addition to existing data requirements Parties shall provide to the Secretariat statistical data on production, imports and exports on:
1989 data for HBFCs and HCFCs 1991 data for methyl bromide
If Parties do not ratify the London Amendment or submit relevant data by 12/5/93, they shall be regarded as
regarded as non-Parties with regard to Annex B CFCS, carbon tetrachloride and 1,1,1 trichloroethane and a ban on trade with Parties shall apply. If non-Parties notify the Secretariat that they are in full compliance with the Protocol's production control and trade control measures and supply appropriate data by 31/3/93, they will be exempt from the trade controls.
Imports and exports of recycled and used controlled substances shall not be taken into account in calculating consumption.
4. Financial mechanism
The Multilateral Fund was made operative from 1/1/93. It was undertaken to evaluate and review the working of the Mechanism by 1995.
5. Essential uses
Limited production for essential uses will be allowed after phaseout. Essential uses must be agreed by all Parties. A use shall qualify as essential only if it is necessary for the health, safety or is critical for the functioning of society (encompassing cultural and intellectual aspects), there are no technically and economically feasible alternatives or substitutes that are acceptable from the standpoint of environment and health and there is not sufficient quantity of recycled material available. Essential use applications must be with the Secretariat at least six months in the case for halons and nine months for other substances prior to each meeting of the Parties to decide on the issue.
6. Recycling and halon banking
Parties were urged to take all practicable measures to recover controlled substances for recycling, reclamation or destruction, to minimize refrigerant leakage and destroy unneeded controlled substances.
