IN THE MATTER of SIR SHUI KIN TANG'S GIFT

OPINION

1.

Sir S.K. Tang made his gift of £1 million by handing over a cheque to the Chief Secretary in Hong Kong on 10th June 1986. The terms of the gift had been set

out three months earlier in his letter of 10th March: it

was to be a donation to Her Majesty's Government in the United Kingdom

"from which the interest accrued is to be used for charitable purposes in the United Kingdom, at the complete discretion of Her Majesty's Government". There was some discussion with Sir S.K. Tang about how

the money was to be used, and the result of these discussions was summarised in a Hong Kong telegram to the FCO on 7th May 1986. Two-thirds of the income was to be

used for Hong Kong students to study in the United Kingdom (administered by the British Council if this could be arranged), and the remaining one-third to go to

a medical trust, such as cancer research.

2.

Senior Crown Counsel in Hong Kong has advised

that the gift did not create a trust under Hong Kong law. On that footing, the money is presumably now held by HMG-
