(5) The Governments will, through their Customs authori
accordance with the provisions set out in this Memorandum,
afford each other mutual assistance:
in

(a) in order to ensure that customs lawS are properly
observed;
(b) in order to prevent, investigate and repress
contravention of customs laws;
(c) in cases concerning delivery of documents regarding
application of customs laws.
Assistance within the framework of this Memorandum will be rendered in accordance with the laws and legal provisions of the requested State and within the competence and available resources
of the customs authority.
(3)
This Memorandum does not provide for the recovery in the
requested State of customs duties, taxes and any other incurred in the requesting State.

COMMUNICATION OF INFORMATION

The Customs authorities of the
two States will supply to their own initiative, all
each other either on request or on available information which may help to ensure proper enforcement
of customs law.
(2) In the case of a request, if the Customs" authority of the requested State does not have the information asked for, it will at its own discretion make enquiries to obtain that information in accordance with the provisions of its customs laws.
