Ordinance (Cap. 366)
(a) In section 2→→
Amendment
(i) repeal the definition of “Regional Council area” and
substitute-
""Regional Council area' has the meaning assigned to it in the Regional Council Ordinance (Cap. 385);":
(ii) repeal the definition of “Urban Council area" and
substitute-
““Urban Council area" has the meaning assigned to it in the Urban Council Ordinance (Cap. 101).":
(iii) add-
““Boundary and Election Commission” means the Boundary and Election Commission established under section 3 of the Boundary and Election Commission Ordinance ( of 1993);".
(b) In section 3 add-
"(IA) The Governor in Council may, by order published in the Gazette-
(a) declare the number of Districts to be declared for the purposes of subsection (1); and
(b) specify a name for each such proposed
District,
and any such order shall have effect in respect of the ordinary election of persons to act as members of a District Board, next following the making of the order, and not earlier.”,
(c) In section 3(2) add “and that of the Boundary and Election
Commission" after “Designated Officer".
(d) In section 3(3) and (4) repeal "Designated Officer” wherever it appears and substitute "Boundary and Election Commission".
(e) In section 3 add--
"(6) The Governor in Council shall, before making a declaration under subsection (1), have regard to any recommendations made under section 18(1)(a)(ii) of the Boundary and Election Commission Ordinance ( of 1993) in the immediately preceding relevant report considered under section 22, of that Ordinance.".
(/) Repeal section 3A.
(g) Add-
"SA. Total number of elected members
The total number of elected members in respect of all the District Boards shall not be substantially greater or less than 338.".
(h) In section 7 add—
"(IA) The Governor in declaring the number of elected members under subsection (1) shall have regard to any recommendations made under section 18(1)(a) of the Boundary and Election Commission Ordinance ( of 1993) in the immediately preceding relevant report considered under section 22 of that Ordinance.".
