(3) A person shall not be liable to conviction

under subsection (1) unless the complaint or information is laid within 3 months from the date of the commission of the offence.".

(v) Repeal section 28 and substitute-

"28. Power to make regulations

The Governor in Council may by regulation provide for, as regards an election—

(a) the amount of any deposit and the

disposal of such deposit;

(b) the number ог qualifications

of

subscribers for a nomination paper; (c) the particulars of any system of voting and counting provided for in this Ordinance; and

(d) the determination of an election

result.".

(w) In section 37(2) add ", the Boundary and Election

Commission" after "Secretary".

(x) Repeal section 37(3) and substitute—

*(3) The Court may make a report as to any matter arising in the course of the trial of an election petition-

(a) of its own motion, to the Governor and

the Boundary and Election Commission where in the opinion of the Court such a report ought to be so made; or

(b) at the request of the Governor or the Boundary and Election Commission, to the Governor or the Boundary and Election Commission, as the case may be.".

(y) In section 41 add "or the Boundary and Election

Commission" after “Secretary”.

(a) In section 2(1)—

(i) repeal the definition of "Urban Council arca" and

substitute-
