LEGCO in due course and it will then be up to LEGCO to decide

whether it wishes to have the court in place before 1 July 1997 or

not, bearing in mind the reservations which they expressed about

the number of foreign judges which you referred to and which I

referred to in the memorandum. The common law will remain in

force after 1997 and the judges in the Court of Final Appeal will

be drawn from Hong Kong and other common law jurisdictions.
