Vacancy for Judge of the High Court

I attach a notification of the above vacancy and recommend, on the advice of the Judicial Service Commission, that Mr. Jerome CHAN Chun-hung, at present a Deputy Registrar, Supreme Court, be appointed a Judge of the High Court.

In my letter of 28 May 1993, I recommended the appointment of Mr. Justice Mortimer to the Court of Appeal. Should this appointment be approved, a consequential vacancy will arise in the High Court.

The Judicial Service Commission had previously recommended the appointment of Mr. Arjan Sakhrani, Q.C. (This was mentioned in paragraphs 13 16 of my letter of 7 January 1993.) However, Mr. Sakhrani has now decided not to seek appointment. At its meeting on 29 May 1993, the Judicial Service Commission reconsidered the candidates previously considered.

In

accordance with Section 3(3A) of the Judicial Service Commission Ordinance, Cap. 92, the resolution to recommend the appointment of Mr. Jerome Chan is effective.

The relevant minutes of the Judicial Service Commission's meeting are at Enclosure 1. The particulars of Mr. Jerome Chan are at Enclosure 2.

The Governor has accepted the recommendation of the Judicial Service Commission and has directed that the

appointment of Mr. Jerome Chan be recommended to the Secretary of State for approval.
