HMOCS: HOME CIVIL SERVICE: SECURITY VETTING AND RESIDENCE

Thank you for your letter of 5 February to Miss Paris.

We have now identified the source of the advice given in 1991 that members/dependents of members of the Royal Hong Kong Police Force (RHKPF) are eligible for a waiver of the five year residence rule. The advice is contained in the enclosed minute from Squadron Leader P Hatton from Rudloe Manor in Wiltshire. In his minute Squadron Leader Hatton states that he has "consulted with the Security Service

who are the authors of the Residency Rules on behalf of the Cabinet office and they have stated that they would be prepared to accept service in the RHKPF as being sufficiently strong Crown connection to form the basis of an application for a waiver of the Residency Rules providing of course all other aspects of the Rules were met". This advice was given in the context of an application from a member of the RHKPF for service in the RAF, and thus the advice was specific to members of the RHKPF. However, I consider that the same argument should apply to other British citizens employed by the Hong Kong Government who are domiciled in the UK.

Bridget Paris spoke to Tony Hardwell last week and he agreed to follow this matter up with the RAF. I should be very grateful for an early response on this question as we hope to hold consultations with members of HMOCS in Hong Kong within the next month or two and this issue is bound to be raised during the course of our talks.

With this aim in mind, we have redrafted the original note taking into account comments from the Cabinet Office and would be grateful for your views. The note may need to be revised further depending on the answer to the question raised above.
