Officers pensions covered by Heads C require references to orders made under both Acts. Head D only requires a reference to the 1975 as it applies only to pensions coming into payment after the introduction of the Scheme. The draft should be amended.
Dependents pensions covered by Head F are therefore covered by orders made under both Acts. In case of a notional dependant's pension calculated by reference to Heads C and D the officer's notional pension will be the same as his root pension and increased accordingly. Again the draft should be amended.
Not all officers and dependants eligible to receive hanafit under the Scheme are eligiblo to receive benefit under Section 11 of the PIA71. The words " or such date as would have been used had the officer been entitled to such a pension supplement" or words along these lines are need to cover this group.
The highest pensionable emoluments (HPE) paid to an officer means throughout his pensionable service; thus his HK pension would be determined by his HPE in Home Service - but this has no relevance to the determination of the notional pension under Heads D and C. Agreed?

brackets produce the same amount? We are trying to ensure that the protected rate does not fall be below that prevailing on the effective date of the Scheme. If the rate is better at the date of his retirement then we will use it to determine the notional pension.
