whichever [is more beneficial to the officer] [produces a larger sum in sterling].

I Death Gratuity

To calculate the sterling value of a notional Hong Kong gratuity in the case of a death gratuity:

(a) Calculate the officer's notional Hong Kong pensionable emoluments in accordance with Head A (a) and (b);

(b) Apply the provisions of the relevant law [as in force on 1st January 1992] [(other than those for supplementing the amount of pensionable service)] to the notional pensionable emoluments to calculate the death gratuity as if they were the pensionable emoluments to be taken for the purpose under the relevant law;

(c) Divide the sum obtained at paragraph (b) by XX; the resulting sum will be denominated in pounds sterling;

(d) Increase the sum obtained at paragraph (c) in April of each year up to the date of the officer's retirement by the appropriate percentage increase payable in respect of a lump sum as provided by the relevant Orders made under section 59 of the Social Security Pensions Act 1975, as from time to time in force as if the sum were a pension begining on 8th April 1991;

(e) The sum obtained at paragraph (d) is the sterling value of the officer's notional Hong Kong gratuity.
