and, on the officer or judge retiring, or proceding on leave pending retirement, on that day, the day immediately preceding the day so nominated will be the appointed day in respect of that officer or judge.

OFFICERS ENTITLED TO COMPENSATION UNDER THIS SCHEME

5. [Overseas] officers who:

(a) were on the permanent and pensionable establishment of the Government of Hong Kong on the 1st May 1993 and remain so on the appointed day; and

(b) are members of HMOCS,

other than officers referred to in paragraph 8 below, will be entitled to compensation under and in accordance with this Scheme, and are herein referred to as "entitled officers".

6. Judges in Hong Kong (that is to say judges of the, Supreme Court and any court to which appeals lie from the Supreme Court, and judges of the District Court) who:

(a) satisfy the condition set out in paragraph 5(a) above; and

(b) either are members of HMOCS or have been individually informed in writing by or on behalf of the Secretary of State that they would be treated in the same manner as a member of HMOCS,

other than judges referred to in paragraph 8 below, will also be entitled as entitled officers to compensation under and in accordance with this Scheme.

7. Members of HMOCS and judges to whom paragraph 6 refers who on the appointed day are seconded for service outside Hong Kong or to a non-Government organisation within Hong Kong will be treated in the same way as other entitled officers.
