"Scheduled officer" has the meaning ascribed to it in the Hong Kong Pension Benefits Ordinance:
"United Kingdom Pensions Increase (Review) Order" means an order made under section 2 of the Pensions (Increase) Act 1971.
RETIREMENT
3.-(1) An entitled officer may, if he has given the requisite period of notice, retire from the public service.
(2) The requisite period of notice is six months, unless a shorter period is agreed between the appropriate civil service authority and the officer or judge concerned.
(3) In this paragraph, "the public service" means the public service in respect of which a pension is payable under the Pensions Ordinance, the Pension Benefits Ordinance, and the Pension Benefits (Judicial Officers) Ordinance.
RETIREMENT BEFORE THE 29TH JUNE 1997
4. ) An officer or judge who, if he were to remain in the public service on the 29th June 1997, would satisfy the requirements of this Scheme to become an entitled officer, may, at any time after the date of the making of this Scheme, give notice of his wish to retire, and may include in such notice his consent to the Governor nominating an earlier day than the 29th June 1997 as the day on which he shall retire or proceed on leave pending retirement.
(2) If the Governor is of the view that it is necessary in the public interest to phase the retirement of members of Her Majesty's Overseas Civil Service (HMOCS) or judges to whom this Scheme applies, he may, with the consent of the Secretary of State and the officer or judge concerned, nominate a day between the 30th June 1996 and the 29th June 1997 for the retirement of that officer or judge or for the date on which he shall proceed on leave pending retirement
