April 1993 should be the final date for officers to make the

transfer from contract terms to pensionable terms in order to be considered for membership of HMOCS. The Secretary of State's

statement on these deadlines was circulated to all existing and

potential members of HMOCS in Hong Kong on 21 January 1993.

Our Legal Consultant has advised that an amendment should be

made to the HMOCS Special Regulations by the Secretary of State to incorporate these deadlines. The reason an amendment is

required specifically in respect of Hong kong is that certain expatriate officers in Hong Kong will continue to be eligible to

transfer to the pensionable establishment for some time yet, and

unless the amendment is made, such officers would be eligible to

apply for membership of HMOCS. Officers in Hong Kong have had

sufficient notice of our intention to bring recruitment to HMOCs

to an end.

If the Secretary of State agrees he should sign the

amendment.
