Hong Kong gratuity:
(a) Calculate the officer's notional Hong Kong pensionable emoluments in accordance with Head A (a) and (b) of Annex I and then apply the provisions of the relevant law to the notional pensionable emoluments to calculate the gratuity in accordance with the option exercised by the officer as if they were the pensionable emoluments to be taken for the purpose under the relevant law;
(b) Divide the sum obtained at paragraph (a) by XX; the resulting sum will be denominated in pounds sterling;
(c) Increase the sum obtained at paragraph (b) in April of each year up to the date of the officer's retirement by the appropriate percentage increase payable in respect of a lump sum as provided by the relevant Orders made under section 59 of the Social Security Pensions Act 1975, as from time to time in force.
(d) The sum obtained at paragraph (c) is the sterling value of the officer's notional Hong Kong gratuity.
B In the case of members of HMOCS ("officers") who retire from a service other than that of Hong Kong or the Hong Kong Special Administrative Region on or after the 1st April 1992 in circumstances in which they are entitled to exercise an oplion for a gratuity under a relevant law Special Administrative Region after the commencemnt of the Scheme in circumstances in which they are entitled to exercise an option for a gratuity under a relevant law
