(2) Where;

(a) any officer or judge to whom paragraph 3 or 4 refers:

(i) who, being entitled to retire under the relevant

pension law, but;

(ii) who will not have reached normal retirement age on or

before 30th June 1997

has expressed the wish to retire immediately following that day, and;

(b) the Governor is of the view that it is necessary in the public interest to phase the retirement of such officers and judges,

the Governor may, with the consent of the Secretary of State and the officer or judge concerned, nominate a day earlier than the 30th June 1997 for the retirement of that officer or judge and on the officer or judge retiring on that day, the day immediately preceding that day shall for the purposes of this Scheme be the appointed day in respect of that officer or judge:

Provided that the Governor shall not nominate a day for the purposes of this Scheme earlier than [30th June 1996).

OFFICERS ENTITLED TO COMPENSATION UNDER THIS SCHEME

3.

Overseas officers who:

(a) are on the permanent and pensionable establishment of the Hong Kong Government on the appointed day; and;

(b) are members of Her Majesty's Overseas Civil Service (HMOCS),

other than officers referred in the paragraph 6 below, will be entitled to compensation under and in accordance with the Scheme

(and are referred to as "entitled officers").

Judges in Hong Kong (ie judges of the Supreme Court and any court to which appeals lie from the Supreme Court and judges of the District Court) who:

(a) satisfy the condition set out in paragraph 3(a) above; and

(b) either are members of HMOCS or Her Majesty's Overseas Judiciary (HMOJ), or were individually informed on or before [1 October 1993] by or on behalf of the Secretary of State that they would be treated in the same manner as a member of HMOCs,

other than judges referred to in paragraph 6 below, will also be entitled as entitled officers to compensation under and in accordance with the Scheme.
