DRAFT REVISED PROPOSALS FOR A SCHEME BY THE UNITED KINGDOM GOVERNMENT FOR MEMBERS OF HMOCS IN THE SERVICE OF HONG KONG

(INCLUDING JUDGES ENTITLED TO BE TREATED IN THE SAME MANNER AS MEMBERS OF HMOCS)

DATE OF INTRODUCTION OF THE SCHEME

1. The Scheme will come into operation in respect of an officer or judge on the appointed day

DEFINITIONS OF "APPOINTED DAY" AND "NORMAL RETIREMENT AGE"

2.(1)

In this Scheme:

"appointed day" in relation to any officer or judge, means the 30th June 1997 or the day immediately preceding such earlier day as the Governor may nominate under sub-paragraph (2) of this paragraph as the day on which the officer shall retire from the service of Hong Kong:

"normal retirement age" means:

a) in the case of an entitled officer, other than a member of the disciplined services or a member of the judiciary:

b)

(i) to whom the the Hong Kong Pensions Ordinance (CAP 89)

applies, 55;

(ii) to whom the Hong Kong Pensions Benefits Ordinance (CAP

99) applies, 60;

in the case of an entitled officer who is a member of the disciplined services:

(i)

(ii)

to whom the Hong Kong Pensions Ordinance applies, 55; to whom the Hong Kong Pensions Benefits Ordinance applies, the age specified under Section 10(3) of that Ordinance, or if no age is specified, 60;

in the case of a judge of the Supreme Court or of any court to which appeals lie from the Supreme Court, 65;

d) in the case of a judge of the District Court appointed as such before 1 January 1987, 60;

e) in the case of a judge of the District Court appointed as such on or after 1 January 1987, 65;

f) in the case of a Registrar or Deputy Registrar of the Supreme Court, to whom the Pensions Benefits (Judicial Officers) Ordinance (CAP 401) applies, 65.
