1. The Secretary of State asked about the report in
Washington telno 1186 that the Hong Kong authorities had
failed on two occasions to impound FRY controlled vessels,
registered in Malta, which had entered Hong Kong.

SCR 820 includes, among other provisions, powers for
States to impound all FRY controlled vessels in their
territories. We implemented these provisions in respect of
Hong Kong by an Order in Council which came into effect on 14
May. The impounding provision has no precedent in
international or UK law and is complex, not least because of
the difficulty in defining what constitutes FRY "control".
The Hong Kong authorities were reluctant to act against
vessels registered in Malta without evidence to corroborate
US allegations that they were in fact FRY controlled.
3. We have now passed to Hong Kong the UK list of FRY controlled vessels on which basis the Department of Transport
make decisions on impounding. We also briefed Mr Goodlad to
raise this during his visit to Hong Kong, 1-2 June.
