The Home Secretary said that he was satisfied that
there was a proper basis for exercising his discretion
to order the return of Mr. Osman and in particular he
said that, in his view, it would not be oppressive or
unjust to return Mr. Osman to Hong Kong. The Home
Secretary also stated that he was satisfied about the
the Hong Kong Government in
undertaking given by

relation to speciality (that is, undertaking not to
place Mr. Osman on trial for any cases other than
those in respect of which his return was ordered). At
the time that the Secretary of State signed the order,
he was
aware that the covering letter from Mr. Osman
had not been received and that an appointment had been
made for three Members of Parliament to see him on
Tuesday 16th June, 1992. After the Home Secretary had
signed the order, that meeting was cancelled. The
Home Secretary subsequently read Mr. Osman's covering
