LORD JUSTICE WOOLF:

Mr.

Osman is now over 60 years of age.

Although a Malay he is now eligible to apply in this country to

be naturalised. He is married with a 17 year old daughter. His

family is in this country. He states that his health now gives

rise to concern and he has had to be treated for a heart

condition. He has been detained in prison for six and a half

years during which he has vigorously contested the extradition

proceedings brought against him by the Hong Kong Government. The

prison in which he is detained is Brixton. That is the prison

in which he has spent most of this period. As is well known the

conditions at Brixton are far from ideal.

If he had been

convicted and sentenced to a period of 10 years imprisonment for

an offence of fraud committed in this country, he would almost

certainly have been detained in much more satisfactory conditions
