D. Denial of access to and subsequent loss of vital evidence

Can the prosecution of Mr. Osman in Hong Kong result in a safe conviction given that a huge number of documents highly relevant to Mr. Osman's defence that BBMB was aware of and authorised the lending to Carrian have now been destroyed or lost by BBMB?

E. Conditions in Hong Kong

(1) In the event of a conviction, will allowance be made for the fact that Mr. Osman has already spent six and a

half years in prison, and by trial probably eight and half years, and will his sentence be reduced accordingly?
