Transfer of quotas among occupational groups and classes

The Order allows the transfer of applications between classes: paragraph 6(1) states that if it appears to the Governor that an application in one class could more appropriately be dealt with in another class, he may treat the application as if it had been made in that other class. There are however no provisions for transfer of quotas among OGs and/or classes. In order to ensure that the 50,000 places are fully utilized in the event of under-subscription in any OGs or classes in the second (and last) phase of the Scheme, it is recommended that flexibility should be provided in the Order for transfer of places among OGs/AOs/disciplined services and/or among classes.

Set out below for members' consideration are the principles and suggestions in respect of how unused places should be transferred in different scenarios of under-subscription :-

(a) in the event of under-subscription in any particular OGs/services in the GOC or the DSC, the unused places should be reallocated to other over-subscribed OGs/services in proportion to their share of their total quotas in the second phase;

in the case of under-subscription in specified OGs in the GOC as a whole, the unused places should be transferred to AOS in the same class, and vice versa;

as a general principle, transfer of places between classes would not be necessary if there were indications that the unused places in a class would be absorbed in that class;

(d) any unused places in the GOC or the DSC should be transferred to the other class for allocation to individual OGs/services in proportion to the latter's share of the quota for the class in the second phase;
