Transfer of quotas among occupational groups and classes

Purpose

This paper sets out HKG's views on providing flexibility in the British Nationality (Hong Kong) (Selection Scheme) Order 1990 (hereafter the Order) for transfer of places among occupational groups (OGs) and/or

classes.

Background

The Order allows the transfer of applications between classes: paragraph 6(1) states that if it appears to the Governor that application in one class could more appropriately be dealt with in another class, he may treat the application as if it had been made in that other class. There are however no provisions for transfer of quotas among OGs and/or classes.

Section 1(1) of the British Nationality (Hong Kong) Act 1990 provides that up to 50,000 heads of families may be registered as British citizens under the BNS.
