The change will probably limit the employment of non British Commonwealth citizens to posts other than public service posts within the meaning of Article 48 (4) of the EEC Treaty. This will ensure compatibility with the eligibility of EC nationals of other Member States for Civil Service posts. Paul Berman in your legal department is aware of these proposed changes in Nationality rules for the Home Civil Service. If and when the changes are approved in principle, by Ministers, the Treasury Solicitor has advised that

"careful consideration will have to be given to whether British Nationals (Overseas) citizens should be eligible under the new arrangements."

I trust this resolves your doubts about the position of BN (0) citizens at least for the present.
