NATIONALITY

RIGHT OF ABODE IN THE UK FOR 3 MILLION BRITISH NATIONALS IN

HONG KONG

It would have been irresponsible for us

commitments or raise expectations that no future British

Government could possibly meet.

BRITISH NATIONALITY ACT 1981: CHILDREN BORN BEFORE

1 JANUARY 1993

Know this is a matter of concern for people in Hong Kong.

We are engaged in discussions about it with new Home Office

Ministers and hope to reach a decision soon.

RIGHT OF ABODE IN HONG KONG AFTER 1997: SOME RESIDENTS STILL

UNCERTAIN THEIR RIGHTS WILL REMAIN

-

Subject still being discussed in JLG. Determined to reach a satisfactory conclusion.

CONSULAR PROTECTION FOR HKBDTC AND BN(0) PASSPORT HOLDERS IN

CHINA

- Holders of BDTC or BN (0) passports enjoy the usual access

to consular protection when travelling abroad.

However in China there is a problem because the government

of the PRC regards them as Chinese nationals.

-

In the case of dual nationals it would not normally be our practice to seek to exercise consular protection on behalf

of British nationals in the country of their other

nationality.
