5 SEC. 202. PRESIDENTIAL ORDER.

(a) PRESIDENTIAL DETERMINATION-On or after

7 July 1, 1997, whenever the Presiden: determines that

8 Hong Kong is not sufficiently autonomcus to justify treat-

9 ment under a particular law of the United States, or any

10 provision thereof, different from that accorded the state

11 exercising sovereignty over Hong Kong, the President may

12 issue an order suspending the applicat on of section 201

13 to such law or provision of law.

(b) FACTOR FOR CONSIDERATION. -In making a de-

15 termination under subsection (a) with respect to the appli-

16 cation of a law of the United States, or any provision

17 thereof, to Hong Kong, the President should consider the

18 terms, obligations, and expectations expressed in the Joint

19 Declaration with respect to Hong Kong.

(c) EFFECTIVE DATE-Such Presidential order shall

21 take effect upon publication in the Federal Register and

22 shall specify the law or provisior of lav affected by the

23 order.
