LOCALISATION OF FUGITIVE OFFENDERS LEGISLATION

1. I attach a draft localisation of Fugitive Offenders Legislation paper. My only commemts on it are:

i) As it is presumably intended to apply to all of para 3, I think that the last tiret in that para should not be inset;

ii) We have, I recall, told the Chinese during the negotiations that we would consider wehter to include a right to instruct in the legislation if necessary. Obviously that would not operate pre-1997, but should it not be in the legislation anyway, and if so should we refer to it in this paper?

2. I should be grateful for any other views you might have on this paper and also for your comments on my minute of 29 July on the quetion of the Order in Council
